Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tapout mobile application and Tapout web dashboard (collectively, the "Services"), operated by Tapout ("Tapout", "we", "us", or "our"). By creating an account or using the Services you agree to be bound by these Terms and by our Privacy Policy.

1. Eligibility & account

You must be at least 16 years old to use the Services. You agree to provide accurate registration information, to keep your password confidential, and to notify us immediately of any unauthorised use of your account. You are responsible for all activity that occurs under your account.

2. The Services

Tapout helps you generate personalised meal and workout plans, log progress, journal photos, and book sessions with coaches on the platform. AI-generated content (meal plans, workout routines) is produced by third-party language models and may contain inaccuracies. Always review suggestions and apply your own judgement before acting on them.

3. Health & safety disclaimer

Tapout is not a medical service and does not provide medical advice, diagnosis, or treatment. Consult a qualified healthcare professional before starting any new exercise regimen, diet, or supplement plan, particularly if you have an existing medical condition, are pregnant, or are recovering from injury. You assume all risk associated with physical activity undertaken based on guidance provided by the Services.

4. User content

You retain ownership of the photos, notes, and other content you upload ("User Content"). You grant Tapout a worldwide, royalty-free, non-exclusive licence to host, store, transmit, and display your User Content solely for the purpose of operating the Services on your behalf. You represent that you have all rights necessary to upload your User Content.

5. Acceptable use

• No unlawful, abusive, harassing, defamatory, or fraudulent activity.
• No reverse engineering, scraping, or interference with the Services or other users.
• No uploading of malware or material that infringes third-party rights.
• No impersonation of Tapout staff or other users.

We may suspend or terminate accounts that violate these rules.

6. Coach bookings

Slots booked with coaches are subject to coach availability. Meeting links are delivered in-app after booking. Cancellations, refunds, and no-show policies are determined per coach; we'll surface the relevant information in-app before you confirm a booking.

7. Subscriptions & payments

If paid features are introduced, you'll be notified before any charge is applied. Payments processed through the Apple App Store or Google Play Store are subject to the platform's billing terms.

8. Intellectual property

All Tapout trademarks, logos, software, and content (other than User Content) belong to Tapout or its licensors and are protected by intellectual property laws. You may not copy, modify, or create derivative works except as permitted by these Terms.

9. Termination

You may stop using the Services at any time and delete your account in-app. We may suspend or terminate access if you breach these Terms or if continued operation poses legal or security risk. Sections that by their nature should survive termination (e.g. disclaimers, limitation of liability, governing law) will continue to apply.

10. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for your circumstances.

11. Limitation of liability

To the maximum extent permitted by law, Tapout will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services. Our total liability will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) INR 1,000.

12. Indemnity

You agree to indemnify and hold Tapout, its officers, employees, and coaches harmless from any claim or demand arising out of your breach of these Terms, your User Content, or your misuse of the Services.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the app or by email. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

14. Governing law & disputes

These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
